The Making Homes Affordable Program MHA
http://keaveneylegalgroup.com/attorney You may have heard how the government bailed out many large corporations, but what has it done to help the little guy? The Making Homes Affordable Program is a government program designed to create a set of standardized guidelines for lenders to use when determining whether a borrower qualifies for a loan modification. So, how does this benefit you? How do you find out if you qualify? What do you need to do to get this assistance? The main part of MHA that affects the average homeowner facing foreclosure is the Home Affordable Modification Program (HAMP). Under HAMP, lenders receive incentives from the government for modifying homeowners' mortgages. Lenders are required to actively inform borrowers about eligibility to participate in the program and to use a certain value calculation for the home specifically developed for HAMP. The value calculation is designed to determine whether the lender would still make any money under the modified loan terms and, if so, the lender is required by law to pursue HAMP before foreclosure. The program has certain rules for eligibility. They are: 1. The loans must have originated on or before January 1, 2009; 2. The loan must be a first mortgage and the borrower must live in the property or the property is rented or the owner intends to rent it; 3. The value of the unpaid balance on the loan must be less than $729,750 (unless the property has 2-4 units); 4. The current principal, interest, property taxes, and homeowner's insurance payments for the property must be costing the borrower over 31% of their gross monthly household income; 5. All borrowers must fully document their income and must sign an affidavit of financial hardship; and 6. The borrower must not have been convicted of a crime related to a mortgage or real estate transaction. Not surprisingly, the financial institutions want to make sure that only those who are actually eligible for such programs are able to take advantage of them. As such, borrowers must provide a great deal of financial information, including IRS tax forms, applications for the program, and documentation proving income. The most common loan modification plan is the HAMP loan modification plan, which is aimed at getting homeowners mortgage payment down to around 33% of your income, giving you an affordable mortgage payment. Many homeowners get approved for HAMP, at which point the bank wants to see you make three trial payments, to make sure you are stable and able to make those payments. It's key that those payments get made, get made on time, and there is nothing weird about them (they don’t get sent back, it’s not the right amount, there aren’t any questions - the key is that it goes smoothly). Anything out of the ordinary could result in not getting approved for the final loan modification. Make sure you fully understand the terms of your payment plan, and comply. Here are some tips: 1. When you do make a payment, always note down the confirmation number - call in and get it if need be. That’s how the bank tracks the payments, so if there is ever a problem you can reference that number. 2. Send your payment early if possible, 2-3 days early will give you time to handle any weird issues that pop up. 3. Send it in the exact right amount - don't send any extra money early on, since it will look like you are able to afford a higher loan modification amount. 4. Find out what method the lender prefers and use it. Registered/certified mail, phone, whatever is best for the lender. Both mortgage modification programs were launched in March 2009 and provide finance adjustment help for those homeowners who qualify. These two modification programs are designed to provide homeowners facing possible foreclosure an opportunity to keep their home. What Is The HAMP Program? The HAMP Program is a mortgage modification helping homeowners who have suffered financial hardship including loss of a job, death of a spouse or loss of household income. It is a loan alteration help to get their home mortgage modified without having to refinance. HAMP Eligibility Requirements Must be living in your property when you apply: Have obtained your mortgage before January 1, 2009; Your mortgage balance is under $729,750 for a single family residence, $934,200 for a duplex, $1,129,250 for a triplex, and $1,403,400 for a 4 unit home; Your mortgage payment (including principal, interest, taxes, insurance, home owners association dues) must exceed 31% of your gross monthly pre-tax income; You can not afford your current mortgage payment due to a financial hardship that can be documented. What Is The HARP Program? The HARP Program is one of the loan modification programs intended to help those homeowners who want to refinance their mortgage but cannot because their homes value has decreased enough to prevent them from qualifying for normal Fannie Mae and Freddie Mac conventional lending loan to value guidelines. A loan changes with HARP may be the answer. HARP Eligibility Requirements Your mortgage must be owned or guaranteed by Fannie Mae or Freddie Mac. (Contact Fannie Mae or Freddie Mac); When applying for the HARP Program loan modification help you must be current on your mortgage payments. Current is defined as not more than 30 days late on your mortgage payment in the last 12 months. If you have had the mortgage for less than 12 months, then you cannot have missed a payment; Your mortgage balance cannot exceed 125% of your homes value; Your income is sufficient to pay back the new mortgage payment; Your mortgage loan modification must improve the long term stability and affordability of your current mortgage. Example: your current mortgage is a 10 year Interest Only Mortgage and you are making a loan modification to a 30 year fixed rate mortgage.

But that could be the tip of the iceberg. A little-reported and little-understood aspect to the foreclosure crisis, claim consumer advocates, is that foreclosure is in fact very profitable for the banks. The banks dispute this, but we've been talking to homeowners across the country who say their servicers pushed them into foreclosure instead of modifying their loans. I’m Thomas Fox, Community Outreach Director for Cambridge Credit Counseling. It has been over a month since the Obama administration announced the U.S. Treasury Department's Making Home Affordable program. While the initiative has its merits, many believe that it falls short of offering struggling homeowners the help they desperately need. To recap, the Making Home Affordable program works in two ways. First, homeowners who are on-time with an existing mortgage owned by Fannie Mae or Freddie Mac may apply for refinancing under the The Home Affordable Refinance portion of the plan. In this case, eligible loans will include those where the first mortgage does not exceed 105% of the current market value of the property. The second part of the Home Affordable Modification allows homeovners who are struggling with making their payments apply to modify their mortage to make thing more manageable. This aspect of the plan is voluntary; therefore, it is unknow how succesfull the initative will be. Both programs have a shelf life – the Home Affordable Refinance program expires in June of 2010 and the Home Affordable Modification program expires on December 31, 2012. The predominant issue affecting homeowners is the drastic decline in the value of their homes – a term known as underwater where a home is worth less than the mortgage. major limitation of the program is that it does not attack the problem of negative equity -- mortgage balances larger than the value of the homes securing the mortgages. Furthermore, 65% of the mortgages originated in 2005 and 2006 were not securitized by either Fannie Mae or Freddie Mac. This means that there is a tremendous amount of homeowners that will not be able to seek help under the program. Economist Nouriel Roubini and market analyst Meredith Whitney predict that prices in the housing market will decline by another 20 percent before they level off. Nearly half of all homeowners will be underwater and owe more on their mortgages than the current value of their homes. That will increase the foreclosures and push scores of banks into default. This logic is backed up by Merrill Lynch’s economist,David Rosenberg, as he thorises that the housing market will need another three years to achieve price stability. Given the Making Home Affordable Cambridge recently launched keepyourhome.us to further the promotion of our Home Sweet Home initiative which achiever economic stabilization through recovery of the housing sector.
